论物联网与知识产权保护

【摘要】  物联网的概念被提出后，世界上一些主要国家发现了其巨大的潜力并投入巨资深入研究物联网信息技术。在世界传感网领域，我国是标准主导国之一，专利拥有量高。在中国知识产权法律制度还在逐步的完善过程中，物联网新技术的产生和应用面临着一系列的挑战。本文在研究物联网现状和知识产权相关法律的基础上为我国在应对物联网等高新技术产业方面提供产权保护战略措施。

Abstract:After the thing networking's concept put forward, in the world some major countries had discovered its huge potential and invests the large amount of money deep research networking information technology. In the world sensing network domain, our country is one of standard leadership countries, the patent capacity is high. In China intellectual property rights legal regime also in the gradual perfect process, the thing networking new technology's production and the application is facing a series of challenges. This article is dealing with high technology and new technology industry aspects and so on networking in the research networking present situation and in the intellectual property rights related law's foundation for our country to provide the property right protection strategic measure.

 物联网被提出后不久就在世界上掀起了一阵研究热潮。我国中科院1999年就启动了物联网的研究并取得了一系列的成就。2005年国际电信联盟正式提出了“物联网”的概念。ＩＢＭ首席执行官彭明盛首次提出“智慧地球”这一概念，建议奥巴马政府投资新一代的智慧型基础设施，此概念一经提出，即得到美国各界的高度关注，甚至有分析认为ＩＢＭ公司的这一构想极有可能上升至美国的国家战略，并在世界范围内引起轰动。物联网研究是世界上各国都在积极研究的未来信息技术，在世界传感网领域，我国是标准主导国之一，专利拥有量高。在中国知识产权法律制度还不够完善之前，新技术的产生和应用面临着一系列的挑战。在经济发展社会，科技引领时代，做好物联网知识产权的保护对于我国政府实施未来国家战略显得特别重要。
